Divorce
Either spouse can file a petition for dissolution of marriage if at least one party has been a Florida resident for the preceding six months. Grounds for divorce in Florida include the no-fault ground of irretrievable breakdown of the marriage (irreconcilable differences), as well as mental incapacity. After making the required financial disclosures and requesting any temporary orders, the parties will enter a period of litigation. Simultaneously, the parties may attempt to resolve the issues in their divorce through mediation, which can be voluntary or court-ordered. If the case goes to trial, the parties will present evidence and make factual and legal arguments to the judge, who will issue court orders regarding alimony, child support, equitable distribution, and parenting and timesharing when granting the divorce.
