Filing for a Divorce in Fort Lauderdale, FL

Many family law issues arise out of divorce cases. The first step in any divorce case under Florida law is to file a petition for the dissolution of marriage. In Florida, all divorces are “no fault” divorces, which means that the party who files for the divorce does not need to allege fault. Rather, to be eligible for a divorce, a party only needs to plead that the marriage is “irretrievably broken.” In addition, at least one of the parties must have lived in the state of Florida for at least 6 months prior to filing.

Fort Lauderdale Child Custody and Time-Sharing

Many family law matters also involve issues of child custody, or parenting and time-sharing. Under Florida’s child custody law, all parents who separate and have minor children must have a Parenting Plan. In situations where the parents can agree to a co-parenting arrangement and time-sharing schedule, the court can approve the Parenting Plan they develop. When parents cannot agree, the court will develop a Parenting Plan that arranges parenting and time-sharing based on the best interests of the child.
